Please read these Terms carefully before using AssistMeIn. By using our platform, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using AssistMeIn, you agree to be bound by these Terms and Conditions. Please read them carefully before using our platform. If you do not agree to these terms, you must not use our services.
Agreement to Terms
- These Terms govern your use of the AssistMeIn platform and all related services.
- By creating an account or using the platform, you confirm you are at least 18 years of age.
- If using the platform on behalf of a business, you confirm you have authority to bind that entity.
- We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
Additional Policies
- Our Privacy Policy describes how we collect and use your data.
- Additional policies (e.g. payment policy, NDIS terms) form part of these Terms.
- In the event of a conflict, these Terms take precedence unless stated otherwise.
Platform Services
AssistMeIn is an online marketplace that connects Service Seekers with Service Providers. We facilitate the connection but are not a party to any service agreement between users.
What We Provide
- A marketplace for posting and bidding on service jobs.
- Tools for communication, scheduling, and payment between users.
- Subscription plans for service providers seeking greater visibility.
- NDIS-supported service listings for eligible categories.
- Identity verification and review systems to build trust.
What We Do Not Provide
- AssistMeIn is not an employer or labour-hire agency.
- We do not supervise, direct, or control the services provided.
- We do not guarantee the quality, safety, or legality of any listed service.
- We are not responsible for disputes between seekers and providers.
Note: Users enter into service agreements directly with each other. AssistMeIn's role is limited to facilitating the connection and payment process.
User Accounts
To use most features of AssistMeIn, you must create an account. You are responsible for maintaining the security of your account and all activity that occurs under it.
Account Responsibilities
- Provide accurate, current, and complete information during registration.
- Keep your password secure and do not share it with others.
- Notify us immediately of any unauthorised use of your account.
- You are solely responsible for all activity under your account.
Service Provider Accounts
- Providers must complete identity verification before bidding on jobs.
- Qualifications, licences, and insurance must be accurate and up to date.
- Subscription plans determine bid limits and platform visibility.
- Providers must comply with all applicable laws in delivering services.
Account Termination
- We reserve the right to suspend or terminate accounts for breach of these Terms.
- You may close your account at any time via account settings.
- Some data may be retained post-closure for legal and compliance purposes.
Fees & Commissions
AssistMeIn charges service providers a commission on completed jobs. Subscription fees apply for providers who wish to access additional features and bid limits.
Commission Structure
- A platform commission is deducted from the provider's earnings on each completed job.
- The commission rate is clearly displayed before a provider accepts a bid outcome.
- Commission rates may vary based on the provider's subscription tier.
- No commission is charged to Service Seekers.
Subscription Fees
- Providers may choose from multiple subscription plans (Free, Basic, Pro, etc.).
- Subscription fees are billed in advance on a monthly or annual basis.
- Higher-tier plans unlock additional active bids and promotional features.
- Subscription fees are non-refundable unless required by law.
Cash Payment Fees
- When a job is paid in cash, providers are required to report and settle the platform commission.
- Outstanding cash fees are tracked and must be cleared within the specified period.
- Failure to pay outstanding cash fees may result in account suspension.
Note: All fees are inclusive of applicable taxes where required. AssistMeIn reserves the right to change its fee structure with reasonable notice to users.
Payments
AssistMeIn supports two payment methods: secure online card payments via Stripe and cash payments agreed between the seeker and provider. Each method has its own process and obligations.
Online Payments (Stripe)
- Payments are processed securely through Stripe, a PCI-DSS compliant payment processor.
- Funds are held in escrow until the job is confirmed complete.
- Once released, providers receive their payment minus platform commission.
- Refunds are processed in accordance with our Refund Policy.
Cash Payments
- Seekers and providers may agree to settle payment in cash upon job completion.
- The platform commission remains due from the provider regardless of payment method.
- Cash payment confirmation must be logged on the platform.
- Disputes over cash payments are subject to admin review.
Refunds & Disputes
- Refund requests must be submitted within the platform's dispute window.
- An admin will review the dispute and determine eligibility for a refund.
- Approved refunds are processed within 5–7 business days.
- Fraudulent refund claims may result in account suspension.
NDIS Usage
AssistMeIn supports NDIS participants in accessing eligible services through our platform. Providers who offer NDIS services must meet all relevant NDIS Quality and Safeguards Commission requirements.
For NDIS Participants (Seekers)
- NDIS participants may use their NDIS plan funding to pay for eligible services.
- Eligible service categories are clearly marked during the ad creation process.
- You are responsible for ensuring the service aligns with your NDIS plan goals.
- Retain invoices and documentation as required by your plan manager or the NDIA.
For NDIS Service Providers
- Providers offering NDIS services must be registered with the NDIS Commission or meet unregistered provider requirements.
- NDIS-specific service listings require additional documentation and admin approval.
- Providers must comply with the NDIS Code of Conduct at all times.
- Misrepresentation of NDIS registration will result in immediate account termination.
Platform Responsibilities
- AssistMeIn facilitates the connection between NDIS participants and providers.
- We review NDIS provider applications but do not guarantee compliance with all NDIS obligations.
- We are not a registered NDIS plan manager or support coordinator.
Note: For questions about your NDIS plan or funding, contact your plan manager, support coordinator, or the NDIA directly.
Prohibited Conduct
To protect the integrity and safety of our platform, the following conduct is strictly prohibited. Violations may result in immediate account suspension or termination.
Misuse of the Platform
- Posting false, misleading, or fraudulent job ads or bids.
- Impersonating another user, business, or organisation.
- Circumventing the platform to arrange payments outside of AssistMeIn.
- Attempting to manipulate the review or rating system.
- Using the platform for unlawful purposes.
Harmful Behaviour
- Harassment, abuse, or threatening behaviour toward other users.
- Discriminatory conduct based on race, gender, disability, or other protected characteristics.
- Sharing other users' personal information without consent.
- Sending spam or unsolicited promotional communications.
Technical Misuse
- Attempting to access systems or data you are not authorised to access.
- Introducing viruses, malware, or harmful code to the platform.
- Using automated tools to scrape, crawl, or interact with the platform.
Termination
Either party may terminate the user relationship at any time. We reserve the right to suspend or terminate access at our discretion where these Terms are breached.
Termination by You
- You may close your account at any time through your account settings.
- Closing your account does not waive any outstanding payment obligations.
- Active jobs or escrow balances must be resolved prior to closure.
Termination by AssistMeIn
- We may suspend or terminate your account for breach of these Terms.
- Serious violations (fraud, abuse, illegal activity) may result in immediate termination without notice.
- We may terminate accounts where there has been extended inactivity.
- We will notify you of termination unless prohibited by law or safety concerns.
Effect of Termination
- Access to the platform ceases upon termination.
- We may retain data for legal and compliance purposes post-termination.
- Certain Terms survive termination, including limitations of liability and governing law.
Limitation of Liability
To the fullest extent permitted by law, AssistMeIn limits its liability for any claims arising from use of the platform. AssistMeIn is a marketplace facilitator, not a service provider.
Limitations
- AssistMeIn is not liable for the quality, safety, or legality of services rendered by providers.
- We are not liable for any direct, indirect, incidental, or consequential damages arising from platform use.
- Our maximum aggregate liability to any user shall not exceed the fees paid by that user in the preceding 12 months.
- We do not warrant that the platform will be uninterrupted, error-free, or secure at all times.
Indemnification
- You agree to indemnify AssistMeIn against any claims arising from your breach of these Terms.
- This includes costs of legal defence and any resulting judgments.
Note: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those cases, our liability will be limited to the maximum extent permitted by applicable law.
Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
Jurisdiction
- These Terms are governed by and construed in accordance with the laws of Australia.
- By using the platform, you submit to the non-exclusive jurisdiction of Australian courts.
- Nothing in these Terms limits your rights under Australian Consumer Law.
Dispute Resolution
- We encourage users to resolve disputes through our in-platform resolution process first.
- Disputes between users (seeker vs provider) are reviewed by our admin team.
- Disputes with AssistMeIn may be escalated to mediation before litigation.
